WORKSHOP TERMS & CONDITIONS
The following terms and conditions form the basis of a contract between Alan Hewitt Photography (‘AHP’) and the person(s) reserving and booking a workshop, purchasing or accepting a gift voucher (‘The Participant’). They were last amended on 23rd April 2020.
1. Deposits, Booking and Payments
1.1 Where a non-refundable deposit is shown in the workshop description:
- the amount shown is required at the time of booking;
- the remaining balance is payable either 60 days prior to the workshop date or by the specified date if one is shown. If final payment is not made within this time-scale AHP reserves the right to treat the booking as being cancelled. The deposit will be retained by AHP;
- if a booking is made within 60 days of the workshop date then the full amount shall be payable at the time the booking is made.
1.2 Where no deposit is stated in the workshop description then the full amount is payable at the time of booking.
1.3 The receipt of a deposit by AHP does not form a contractual booking. A contract between AHP and The Participant will exist when a booking has been confirmed by AHP by email or in writing.
2. Cancellations
2.1 A cancellation made by The Participant must be done so by email or in writing.
2.2 When a workshop is cancelled 60 (Kenya, Highlands & Eagles: 90) or more days before the date of the workshop the non-refundable deposit will be retained by AHP as a cancellation administrative charge.
2.3 If the cancellation is made less than 60 days (Kenya, Highlands & Eagles: 90) of the workshop date the cancellation administrative charge will equal the full cost of the workshop and will be retained by AHP.
2.4. AHP reserves the right to cancel any package should it not be deemed viable for any reason. The Participant will be notified and offered a choice of either:
a) booking a place on an alternative workshop (any overpayment will be refunded);
b) or withdrawing from the contract and accepting a full refund of any money paid. Refunds of money will be made by BACS transfer.
3. Amendments
3.1 AHP reserves the right to make amendments to the details and itinerary of any workshops. However, in the event of such an amendment substantially changing the itinerary of a workshop The Participant will be notified and offered a choice of:
a) accepting the amendment;
b) booking a place on an alternative workshop (any overpayment will be refunded);
c) withdrawing from the contract and accepting a full refund of any money paid. Refunds of money will be made by BACS transfer
3.2 AHP also reserves the right to amend the advertised cost of any package if that cost has been erroneously advertised. The Participant may in this case cancel the booking and all monies paid by The Participant will be refunded in full by BACS transfer.
4. Personal Injury and Loss
4.1 AHP does not accept responsibility or liability for death, physical injury, illness or any other harm caused to The Participant unless it arises from the direct negligence of a representative of AHP while acting in the course of their responsibilities for a workshop at which The Participant is fully paid up and taking part.
4.2 AHP does not accept responsibility for the loss of or damage to any items, personal effects, clothing, money, equipment, photographic or otherwise.
4.3 Any such claims shall be subject to English law only and legal proceedings shall be exclusively within the English courts only.
5. General
5.1 If The Participant has any special requests or requirements they should inform AHP of these prior to the workshop. AHP will endeavour to meet any reasonable requirements and will advise the relevant supplier of The Participant’s requirements. However, AHP cannot guarantee that such requests will be met. Unless AHP has confirmed in writing that such requests have been agreed, AHP will have no requirement to meet the request.
5.2 AHP endeavours to follow the advertised itinerary but as there are so many variables such as weather, wildlife etc. The Participant should understand that a reasonable amount of flexibility will be required with the itinerary. A workshop description must be taken as an indication of what is likely to take place at that workshop and not as a contractual obligation of AHP to provide the exact details of the description.
5.3 AHP does not accept any liability for any loss or additional expense caused to The Participant by delay or interruption to travel services as a result of weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness, acts of god, or anything else out of AHP’s control and influence. Any such losses or additional expenses are the responsibility of The Participant.
5.4 The Participant must communicate any perceived failure in the fulfilment of this contract by AHP to AHP immediately so that the matter can be dealt with and remedied at that time by AHP if this is practicable. If a complaint arises after the workshop that could not have reasonably be dealt with at the time, The Participant should inform AHP in writing within 14 days of the perceived failure occurring.
5.5 AHP considers the welfare of wildlife subjects to be of the utmost importance and reserves the right to cancel or suspend any activity where AHP deems the behaviour of The Participant is or is likely to be unacceptably disturbing or injurious to the wildlife in question.
5.6 In the event of cancellation or suspension of an activity described in 5.5, AHP reserves the right to cancel the contract with The Participant without refund of any of The Participant’s paid up workshop fees and shall not be liable financially or otherwise for its actions.
5.7 By paying the deposit or full booking fee for a workshop The Participant agrees to accept all of the conditions in this contract. If a separate party, or multiple parties pay for a workshop in part or in full on behalf of The Participant, that party or those parties will become jointly and severally bound by the contents of this contract.
6. Gift Vouchers
6.1 All other Terms & Conditions apply.
6.2 Gift vouchers can be redeemed against workshops subject to availability.
6.3 Gift Vouchers are not fully or partly redeemable for cash.
6.4 Unspent balances can be carried over as a discount on another workshop with use of a coupon code.
